In the event of any claim being made against UFZ or against any members of the timbre project team or supplier projects as a result of breach of these terms and conditions by a user, the user undertakes to fully indemnify UFZ or any members of the timbre project team or supplier projects against all actions, claims, proceedings, damages and costs arising from or incurred by reason of a user's breach of these terms and conditions.

Sharing information

timbre website producers, details of whom can be found at the top of these terms and conditions may disclose your information to each other.

Thetimbre website  producers share your information amongst themselves and may provide your information to carefully selected third parties working with timbre, including the European Commission, to further the purposes of the timbre project.

The timbre website producers will not sell, rent or trade any of the personal information you submit to us. The HOMBRE web site producers are not responsible for the privacy practices or the content of any web sites which may be accessed through a link on timbre's site.

If the assets of any incorporated or unincorporated timbre website producer's business are acquired by a third party the timbre website producers may transfer the data they hold to that third party as well as the relevant party's advisors.

Where a third party seeks disclosure of your personal information for legal reasons you agree that we may disclose your information to such third party.

Security

The timbre website producers are committed to the security of the personal information you submit to us and we have adopted appropriate security procedures to protect the personal data under our control against loss, misuse, unauthorised access, unlawful processing or alteration. The steps we have taken include ensuring the reliability of those in the timbre project who have access to personal data.

It is the registered users' responsibility to ensure that their passwords are kept secure in order to protect against unauthorised access to the message board or other interactive parts of the site. Registered users will be held responsible for unauthorised access and any related claims, losses, costs or liability that the timbre website producers may be subject to as a result.

Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. Users of this site represent and warrant that they are at least 18 years of age and that all information that they submit is true and accurate. If users are acting as an agent they represent and warrant that they are duly authorised to legally bind the principal entity or person to all terms and conditions relating to use of this site and that you have made the entity or person you are acting for aware of them.

Not withstanding the foregoing, none of the exclusions and limitations in these terms and conditions are intended to limit any rights you may have as a consumer under local law or other statutory rights which may not be excluded nor in any way to exclude or limit the timbre website producers liability to you for fraudulent misrepresentation or death or personal injury resulting from our negligence.

timbre does not send out SPAM, (sometimes known as unsolicited emails), nor are our servers being used to send out SPAM. SPAM attributed to timbre-project.eu originates from viruses such as W32.Sobig.F which are mass-mailing worms that send themselves to all the email addresses that they find on a host's system. These emails typically use fake FROM addresses. These addresses are arbitrarily picked from the internet and unfortunately they occasionally use the domains timbre-project.eu.

Commercial bulk e-mail organisations (spammers) also use fake FROM address in order to circumvent anti-spam software.

By using this site or submitting your email addresses users accept that there is a possibility that users may receive SPAM, and that at present there is nothing timbre can do about this. Users further agree not to use any information posted on the website to send SPAM.

timbre website producers reserve the right to amend these terms and conditions at any time. All such changes shall take effect once they have been posted on the website and users will have be deemed to have accepted any such changes by their use of the website from such time.

Each provision of these terms and conditions shall be construed separately and independently of each other and the validity of any one part shall not affect the validity of any other part.

This site is controlled by UFZ and University of Tübingen in Germany on behalf of the timbre project team and the laws of Germany shall apply to the terms of use and any disputes arising in connection with the use of this website. All disputes arising in connection with this website shall be submitted to the exclusive jurisdiction of the German courts.
